The European Media Freedom Act, now enforced across all EU member states, seeks to safeguard press freedom and protect the confidentiality of journalistic sources. However, provisions in Article 3(b) and Article 4(c) allow authorities to arrest journalists if deemed necessary for a “compelling public interest,” evaluated on a case-by-case basis.
The law states:
“Member States shall not… detain, sanction, intercept or inspect media service providers” unless such actions are “justified on a case-by-case basis by an overriding reason of public interest.”
Additionally, the Act includes measures to combat “disinformation” and permits surveillance in cases involving serious crimes, such as terrorism or racism. It mandates cooperation among national regulatory bodies to address misinformation and requires the creation of “national lists” detailing media outlet owners and their addresses, as outlined in Article 6.
While EU Commission President Ursula von der Leyen emphasized that “a free and independent press is an essential pillar of our democracy,” critics warn that the law’s provisions could be used to restrict journalism under the pretext of protecting public interest.
