JUST IN: Federal judge dismisses antisemitism lawsuit against Penn and criticizes lead plaintiff Eyal Yakoby’s claims.Eyal Yakoby, who told Congress he “did not feel safe” at the University of Pennsylvania, was a lead plaintiff in a lawsuit dismissed this week by a federal judge.
In a sharply worded 20-page opinion, Judge Mitchell Goldberg tossed the complaint, filed by Jewish students and the group Students Against Antisemitism, calling it bloated with “unrelated facts,” including allegations of antisemitic incidents across the U.S. and globally, not just on Penn’s campus.
The judge found no evidence Penn acted in a way that “could be interpreted as antisemitic with the intention of causing harm,” even under the most favorable interpretation. He concluded that, “at worst,” the plaintiffs accused Penn of “tolerating and permitting the expression of viewpoints which differ from their own.”
Goldberg also criticized the “unnecessarily inflammatory and impertinent” language in the filing and warned that if plaintiffs attempt to amend the suit again, they must significantly narrow its scope. Penn’s motion to dismiss was granted in full, though plaintiffs are allowed a limited chance to revise two specific claims.
